In the days after Sandy, the NYC Marathon was ready to go. Participants were told to come to NYC, regardless of the recent storm, and they did. Then, just 2 days before the event, the organizers decided to cancel it. A claim was filed against the insurer that provided coverage should the event be cancelled. Storm, snow, etc. (as the direct cause) – covered. Choosing not to have an event that could have been held – probably not. (We don’t have access to the actual policy).
Should the insurer cover the claim?
